Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the NEXLEC website and any related webpages, forms, or online services operated by Next Build LLC, a Florida limited liability company (“NEXLEC,” “Next Build,” “we,” “us,” or “our”).

NEXLEC is a trade name, brand, or division operated by Next Build LLC. References to NEXLEC in these Terms include Next Build LLC where applicable.

By accessing or using the Site, you confirm that you are at least 18 years of age and agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Site.

The Site provides general information about our residential, commercial, and new-construction electrical services, including electrical installations, upgrades, repairs, troubleshooting, project coordination, and related services.

All information provided through the Site is for general informational and marketing purposes only. A binding agreement between you and NEXLEC is created only when the appropriate parties sign a separate written contract, proposal, work authorization, or service agreement.

1. Services and Use of the Site

The Site may provide information regarding:

  • Residential electrical services;

  • Commercial electrical services;

  • New-construction electrical installations;

  • Electrical remodeling and renovation work;

  • Electrical panel and service upgrades;

  • Lighting installation and electrical design coordination;

  • Electrical troubleshooting, repairs, and replacements;

  • Generator, EV charger, appliance, equipment, and specialty electrical connections;

  • Electrical inspections, permitting, and code-compliance coordination;

  • Contractor, developer, builder, property manager, and business-to-business partnerships;

  • Project photographs, conceptual images, diagrams, service descriptions, and portfolio materials;

  • Estimate, consultation, and service-request forms; and

  • Educational or informational content concerning electrical systems, construction, maintenance, and electrical safety.

Service availability may vary based on property location, project scope, scheduling, permitting requirements, utility-provider requirements, licensing limitations, material availability, site conditions, and other factors.

Any pricing, budgets, schedules, timelines, service descriptions, product references, photographs, drawings, or project expectations published on the Site are estimates, examples, or general information only. They do not constitute a binding offer, quote, contract, warranty, or guarantee.

A formal scope of work, price, payment schedule, project timeline, warranty, and the responsibilities of each party will be established only through a separate written agreement signed or otherwise formally accepted by the appropriate parties.

2. Estimates, Proposals, and Project Information

Any estimate, preliminary budget, or pricing range discussed through the Site, by telephone, by email, or during an initial consultation is subject to verification and change.

Final pricing may be affected by factors including:

  • Existing electrical conditions;

  • Concealed wiring or equipment;

  • Accessibility;

  • Code requirements;

  • Permit and inspection requirements;

  • Utility-provider requirements;

  • Engineering or design revisions;

  • Material and equipment costs;

  • Labor availability;

  • Site conditions;

  • Changes requested by the customer;

  • Conditions discovered after work begins; and

  • Work performed by other contractors or third parties.

Unless expressly stated otherwise in a signed written agreement, estimates are not guarantees of the final project price or completion date.

A proposal or estimate may expire on the date stated in that document. If no expiration date is stated, NEXLEC may revise or withdraw it before a written agreement is accepted.

3. Acceptable Use and Restrictions

Personal and Informational Use

The Site and its content are provided for lawful, personal, and informational use. You may not use the Site or its content for unauthorized commercial purposes.

No Automated Access

You may not use bots, scrapers, crawlers, data-mining tools, artificial-intelligence training tools, or other automated methods to extract, collect, copy, reproduce, or republish content, photographs, layouts, designs, service information, or other materials from the Site, except for ordinary search-engine indexing.

Accuracy of Information You Provide

You agree to provide accurate, current, and complete information when submitting a form, requesting an estimate, scheduling a consultation, or otherwise communicating with us.

You are responsible for notifying us if information relevant to your request or project changes.

Prohibited Conduct

You may not:

  • Use the Site for an unlawful, fraudulent, or deceptive purpose;

  • Impersonate another person or misrepresent your identity or authority;

  • Submit false, misleading, or unauthorized project information;

  • Upload malicious software, viruses, or harmful code;

  • Attempt to gain unauthorized access to the Site or connected systems;

  • Interfere with the Site’s functionality, availability, or security;

  • Use the Site to harass, threaten, or harm another person;

  • Copy or exploit Site content without authorization; or

  • Violate the intellectual-property, privacy, or legal rights of another party.

We may restrict or terminate access to the Site when we reasonably believe these Terms have been violated.

4. Intellectual Property

All content displayed on the Site, including text, graphics, photographs, videos, logos, icons, layouts, branding, service descriptions, project materials, and the NEXLEC name, is owned by Next Build LLC, used with permission, or licensed from third parties.

This content is protected by applicable copyright, trademark, trade-dress, and other intellectual-property laws.

Except as expressly permitted in writing, you may not:

  • Copy, reproduce, republish, or distribute Site content;

  • Modify or create derivative works from Site content;

  • Use Site content in advertising, marketing, or another business;

  • Remove copyright, trademark, or ownership notices;

  • Sell, license, or commercially exploit Site content;

  • Present our work, photographs, or materials as your own; or

  • Use the NEXLEC name, logo, branding, or confusingly similar marks.

Limited sharing of a public webpage for personal, referral, or informational purposes is permitted, provided the content is not altered and NEXLEC is properly identified as the source.

5. Photographs, Diagrams, and Project Examples

Photographs, graphics, diagrams, equipment images, completed-project examples, and conceptual materials displayed on the Site are provided for illustrative, educational, inspirational, or marketing purposes.

Products, fixtures, equipment, finishes, wiring methods, layouts, and other features shown on the Site may:

  • Be associated with a different property or project;

  • No longer be available;

  • Require additional labor or materials;

  • Be subject to manufacturer changes;

  • Differ from the final installation;

  • Require engineering, permitting, or utility approval; or

  • Be unsuitable for a particular property or electrical system.

Final equipment, materials, methods, specifications, and installation requirements will depend on the project agreement, applicable codes, site conditions, manufacturer instructions, permitting requirements, inspections, and the authority having jurisdiction.

6. No Professional or Emergency Advice

Information on the Site is general in nature and is not a substitute for an on-site inspection, professional electrical evaluation, engineering review, code analysis, or project-specific consultation.

The Site does not provide legal, financial, tax, engineering, architectural, real estate, insurance, or investment advice.

Electrical systems can present risks of shock, electrocution, fire, equipment damage, and serious personal injury. You should not attempt electrical work based solely on information provided through the Site.

The Site is not an emergency-response service. Do not use a website form, email, social-media message, or voicemail to report an immediate electrical emergency.

If you observe fire, smoke, sparking, a burning odor, exposed energized wiring, or another condition presenting an immediate threat to people or property, move to a safe location and contact 911, the fire department, the appropriate utility provider, or another emergency authority.

7. Forms, Inquiries, and Electronic Communications

Submitting a form, requesting an estimate, contacting NEXLEC, or receiving a response from us does not create a contractor-client relationship, fiduciary relationship, partnership, joint venture, employment relationship, or binding service agreement.

A formal contractor-client relationship is established only through a separate written agreement or work authorization accepted by the appropriate parties.

When you provide your email address or phone number, you authorize us to contact you regarding your inquiry, appointment, estimate, project, invoice, or service request.

Communications may be delivered by telephone, email, or text message. Message and data rates may apply. You may request that nonessential text messages stop by replying STOP or contacting us directly.

You are responsible for ensuring that you are authorized to provide any telephone number, email address, property information, photograph, plan, or document submitted to us.

Information submitted through the Site will be handled in accordance with our Privacy Policy.

8. Third-Party Websites and Services

The Site may include links to, embeds from, or integrations with third-party websites and services, including:

  • Website-hosting services;

  • Scheduling platforms;

  • Mapping services;

  • Social-media platforms;

  • Analytics providers;

  • Customer-management systems;

  • Payment processors;

  • Equipment manufacturers;

  • Suppliers; and

  • Utility or government websites.

NEXLEC and Next Build LLC do not control and are not responsible for the content, accuracy, availability, security, privacy practices, or terms of third-party websites or services.

Your use of a third-party website or service is governed by that third party’s own terms and policies.

9. Website Disclaimer

The Site and its content are provided on an “as is” and “as available” basis.

To the fullest extent permitted by applicable law, NEXLEC and Next Build LLC disclaim all warranties concerning the Site, whether express, implied, statutory, or otherwise, including warranties of:

  • Accuracy;

  • Completeness;

  • Availability;

  • Reliability;

  • Merchantability;

  • Fitness for a particular purpose;

  • Title; and

  • Non-infringement.

We do not warrant that the Site will operate without interruption, delay, error, security vulnerability, virus, or harmful component.

We may change, suspend, remove, or discontinue any portion of the Site without prior notice.

10. Limitation of Liability

To the fullest extent permitted by applicable law, NEXLEC, Next Build LLC, and their respective owners, members, managers, employees, representatives, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

  • Your access to or use of the Site;

  • Your inability to access or use the Site;

  • Your reliance on information published through the Site;

  • Errors, omissions, interruptions, or delays;

  • Unauthorized access to or alteration of information;

  • Third-party websites or services; or

  • Any content, communication, or material obtained through the Site.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded.

Nothing in these Terms modifies, limits, or replaces the warranties, remedies, duties, or obligations contained in a separately executed written agreement between you and NEXLEC or Next Build LLC.

11. Separate Service Agreements Control

All electrical, construction, consulting, design-coordination, project-management, and related services provided by NEXLEC or Next Build LLC will be governed by the written contract, proposal, work authorization, purchase order, subcontract, or other agreement applicable to that particular service or project.

A separate agreement may contain additional provisions regarding:

  • Scope of work;

  • Exclusions;

  • Pricing;

  • Deposits and payments;

  • Change orders;

  • Scheduling;

  • Delays;

  • Permits and inspections;

  • Customer responsibilities;

  • Site access;

  • Concealed conditions;

  • Materials and equipment;

  • Warranties;

  • Dispute resolution;

  • Insurance;

  • Indemnification; and

  • Limitation of liability.

If a conflict exists between these Terms and a signed written agreement, the signed written agreement will control regarding the project or service covered by that agreement.

12. Licensing and Regulatory Information

Electrical work will be offered and performed only within the scope of the applicable licenses, registrations, permits, and legal requirements.

License information displayed on the Site is provided for identification and verification purposes. Customers should confirm current licensing information through the Florida Department of Business and Professional Regulation or another applicable licensing authority.

The identification of a license on the Site does not expand the legally authorized scope of that license.

13. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless NEXLEC, Next Build LLC, and their owners, members, managers, employees, representatives, contractors, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the Site;

  • Your violation of these Terms;

  • Information or materials you submit without proper authority;

  • Your infringement of another party’s rights; or

  • Fraudulent, misleading, or harmful conduct committed through the Site.

This provision does not require you to indemnify any party for conduct for which indemnification is prohibited by applicable law.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Unless applicable law requires otherwise or a separate written agreement provides a different dispute-resolution procedure, any legal action arising solely from these Terms or use of the Site must be brought in the appropriate state or federal court located in [Insert County], Florida.

You consent to the personal jurisdiction and venue of those courts.

15. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the greatest extent permitted by law.

The remaining provisions will continue in full force and effect.

16. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision at a later time.

A waiver is effective only when made in writing by an authorized representative of Next Build LLC.

17. Changes to These Terms

We may update these Terms periodically to reflect changes in our services, business practices, technology, or legal obligations.

The Effective Date at the top of this page indicates when these Terms were most recently revised.

Material changes will be posted on the Site. Your continued use of the Site after revised Terms are posted constitutes your acceptance of those revisions.

18. Entire Agreement Regarding the Site

These Terms, together with our Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and Next Build LLC regarding your use of the Site.

These Terms do not replace or modify any separately executed service, construction, subcontractor, employment, or project agreement.
